Getting the notice right
- Time it. Count the notice period from the day the tenant receives it, not the day you write it, and add a few days if you mail it.
- Check caps. California, Oregon and Washington have statewide limits on yearly increases, and many cities have rent stabilization. The calculator can check the statewide caps.
- Be specific. State both the old and new amounts and the exact effective date. Vague notices are the ones that get disputed.
- Keep proof. Save a dated copy and a record of delivery, such as a certified-mail receipt or a signed acknowledgment.
Questions people ask
What should a rent increase letter include?
The date of the notice, tenant names and the property address, the current rent, the new rent, the date the new rent takes effect, a statement that other lease terms stay the same, and how to contact you. Keep a copy and note how and when it was delivered.
How much notice do I need to give?
At least what your state and city require, and never before a fixed-term lease allows it. Thirty days is a common minimum for month-to-month tenancies, but many places require 60 or 90 days, especially for larger increases. Check the current rules where the property is.
How should I deliver the notice?
Use a method your lease and local law accept, typically personal delivery or first-class or certified mail, and sometimes email if the lease allows it. Mailing can add days to the notice period in some states.
Do I need to give a reason for the increase?
Usually not for market-rate units. In rent-controlled or stabilized units, allowable increases and justifications are regulated. A short, honest reason (higher property taxes, insurance or maintenance costs) often makes a renewal go more smoothly.
